How to Apply for a Self-Employment Work Authorization

The self-employment work authorization is a permit that allows foreigners to reside and work in Spain as self-employed individuals. This type of authorization is essential for those who wish to start a business or offer services independently within Spanish territory. Below, we explain the steps to follow and the necessary requirements to apply for this authorization.

Requirements for Applying for Self-Employment Work Authorization

Before starting the process, it is important that you meet certain requirements:

  1. Nationality: Be a national of a country not belonging to the European Union (EU) or the European Economic Area (EEA).
  2. Legal capacity: Have legal capacity to work, meaning you must be of legal age or emancipated.
  3. Business plan: Present a viable business plan that justifies the establishment of the economic activity.
  4. Economic means: Demonstrate that you have sufficient financial resources to carry out the activity and support your residency in Spain.
  5. Documentation: Provide the necessary documentation proving both your identity and your education and professional experience.

Steps to Apply

1. Prepare the Necessary Documentation

Before submitting the application, ensure that you gather all the required documentation, including:

  • Valid and current passport.
  • Criminal record certificate from your country of origin, and if you have resided in other countries, also from those.
  • Report on the economic activity to be developed.
  • Proof of financial means.
  • Completed application form EX-1.

2. Submit the Application

The application must be submitted at the Foreigners' Office or at the diplomatic or consular representation of Spain in your country of origin. You can submit your application in person or through a legal representative.

3. Wait for the Resolution

Once the application is submitted, the Administration has a period of 3 months to resolve it. If this time passes without a response, the application will be considered denied.

4. Obtain the Foreigner Identity Card (TIE)

If the application is approved, you must apply for the Foreigner Identity Card (TIE) within 30 days from the notification of the resolution. This card will allow you to reside and work in Spain legally.

Final Considerations

It is important to note that the self-employment work authorization is valid for one year and is renewable as long as you continue to meet the established requirements. Additionally, it is advisable to seek legal advice to facilitate the process and ensure that all legal aspects are met.

With the right information and compliance with the requirements, applying for a self-employment work authorization in Spain can be a relatively straightforward process.
