Requirements for foreigners for professional athletes

Immigration Requirements for Professional Athletes

The arrival of professional athletes in Spain has increased in recent years due to the growing popularity of various sports and the improvement of sports leagues. However, to reside and work legally in the country, foreign athletes must meet certain immigration requirements. This article details the most relevant aspects for obtaining a residence and work permit in Spain.

Types of Residence Permits for Athletes

Professional athletes can apply for two main types of residence permits in Spain:

1. Work Permit for Employment

This permit is for athletes who have been contracted by a club or sports entity in Spain. To obtain it, the following requirements must be met:

  • Job Offer: The athlete must have a formal employment contract with a club or sports entity.
  • Compliance with Labor Requirements: The club must demonstrate that the athlete possesses the necessary training and experience for the activity they will undertake.
  • Not Being a Detached Worker: The athlete cannot have been hired as a detached worker from another country.

2. Work Permit for Self-Employment

This type of permit is less common, but it is intended for athletes who wish to start their own sports activity in Spain. Requirements include:

  • Business Plan: Present a plan that justifies the feasibility of the sports activity to be developed.
  • Sufficient Economic Means: Demonstrate that sufficient financial resources are available to carry out the activity.
  • Registration in Social Security: Enroll in the corresponding Social Security scheme.

Required Documentation

To apply for either of these permits, it is essential to present the following documentation:

  • Valid Passport: It must be current and have a minimum validity of six months.
  • Recent Photographs: Usually, two passport-sized photographs are required.
  • Criminal Record Certificate: This document must be issued in the country of origin and, in some cases, also in Spain.
  • Medical Report: A certificate that verifies the athlete's health status.
  • Employment Contract or Business Plan: Depending on the type of permit requested.

Application Process

The procedure for applying for the residence and work permit can vary depending on the type of permit. Generally, the steps are as follows:

  1. Submission of Application: The documentation must be submitted to the corresponding Immigration Office or at the Spanish Consulate in the country of origin.
  2. Resolution: The administration has a period of 3 months to resolve the application. After this time, if there is no response, the application is considered denied.
  3. Obtaining the Foreigner Identity Card (TIE): Once the application is approved, the athlete must apply for the TIE within 30 days.

Conclusion

The immigration requirements for professional athletes in Spain are clear and must be met to work and reside legally in the country. It is advisable for interested parties to seek legal advice to facilitate the process and ensure that all documentation is in order.
