Economic requirements for family reunification

Economic Requirements for Family Reunification

Family reunification is a process through which a foreign citizen legally residing in Spain can bring their family to join them. This process is regulated by the Immigration Law, and one of the most important aspects to consider is the economic requirements. Below, we explain in detail what these are.

General Economic Requirements

In order to carry out family reunification, the applicant must demonstrate that they have sufficient economic resources to support the family members they wish to reunite. The economic requirements are divided into the following key points:

1. Economic Sufficiency

The applicant must prove that they have sufficient income to cover their own needs and those of the family members they wish to reunite. This can be demonstrated through:

  • Employment Contracts: Presenting a valid employment contract that proves monthly income.
  • Tax Returns: Justifying income by submitting the most recent tax returns.
  • Bank Statements: Providing bank statements that evidence the availability of funds.

2. Minimum Interprofessional Salary

The minimum amount required depends on the number of family members to be reunited. As of 2023, the minimum interprofessional salary (SMI) is a key indicator. For each additional family member that the applicant wishes to reunify, they must prove income that, in total, amounts to:

  • For the spouse or partner: 1.5 times the SMI.
  • For each child: an additional 0.5 times the SMI.

This means that if, for example, one wishes to reunite a spouse and two children, the applicant must demonstrate income equivalent to 2.5 times the SMI.

3. Adequate Housing

In addition to the economic requirements, it must be demonstrated that there is adequate housing for the family to be reunited. This can include:

  • Lease agreements or property deeds.
  • A certificate of registration indicating the capacity of the dwelling.

Exceptions and Considerations

It is important to keep in mind that there are some exceptions to the economic requirements, especially for certain groups, such as asylum seekers or those who have obtained international protection. However, it is always advisable to consult with a lawyer specialized in immigration law to assess each specific situation.

Conclusions

Meeting the economic requirements is essential to carry out family reunification in Spain. Make sure to gather all the necessary documentation, and if possible, seek legal advice to facilitate the process. Family reunification can be a crucial step towards reuniting with your loved ones in Spain.
